La visa U es una visa que fue creada para los extranjeros para animar a los emigrantes a reportar un crimen y cooperar con la policía. La visa U está disponible para emigrantes documentados e indocumentados que han sufrido cierto tipo de crímenes y colaboran con la policía. Proporcionan información acerca del sospechoso y expresan su voluntad de declarar en contra del si es requerido. Requisitos de la Visa U

El emigrante interesado en aplicar para la visa U necesitará la planilla I-918 llamada “petición de estatus para no emigrante.” La petición deberá ser acompañada por evidencia probatoria de su caso con USCIS. Los siguientes requisitos son requeridos:

  • Tipo de acto criminal de la cual fue víctima
  • Crimen acontecido en Estados Unidos
  • La victima puede ser directa, indirecta o testigo presencial del crimen
  • Padre, custodio o amigo de una víctima menor de 16 años que demuestre información valiosa
  • Víctima sufrió de abusos con daños físicos o mentales sustanciales
  • Cooperación con la policía y fiscalía
  • Victima dio información útil acerca del crimen
  • Recibió una certificación firmando su cooperación con la investigación.

Haber sufrido lesiones o abusos físicos o mentales

La víctima no ciudadana debe demostrar que sufrió daños físicos o mentales considerables. Abuso como resultado de uno o más de los delitos calificados bajo INA§101 (a) (15) (U) (iii). USCIS analizará factores tales como: el tipo y la gravedad de los daños físicos o mentales o las lesiones y el Grado de fuerza o violencia utilizada por el perpetuador. El solicitante no ciudadano deberá proporcionar pruebas de apoyo tales como registros médicos, fotos, informes psicológicos, declaraciones de testigos, y una descripción detallada del daño físico o mental al solicitante. USCIS revisará la solicitud y documentación de respaldo antes de denegar o otorgar la Visa U.

La Visa U puede renunciar a la presencia ilegal anterior, trabajo no autorizado, deportaciones anteriores, ilegal volver a entrar a los Estados Unidos y detener los procedimientos de deportación. Otro beneficio importante de la Visa U es que permite a los no ciudadanos solicitar un permiso de trabajo, una tarjeta verde y solicitar Ciudadanía después de cinco años.
