Sobre Cargos Por Robo Con Entrada Ilegal
El robo con entrada ilegal es un tipo de robo en donde se entra ilegalmente a una estructura. El robo con entrada ilegal va más allá de las casas; y lo pueden acusar de robo por entrar ilegalmente en un vehículo, contenedor de carga, caja fuerte o otra estructura. Usted no necesariamente tiene que llevarse algo para que lo acusen de robo con entrada ilegal.
Mientras la fiscalía pueda demostrar que usted entró ilegalmente a la estructura con la intención de cometer un delito (aunque el delito nunca se haya cometido), usted puede ser acusado de robo con entrada ilegal.
En California hay dos clasificaciones para los cargos por robo con entrada ilegal:
Robo con entrada ilegal de primer grado - Un delito mayor aplica cuando la estructura a la que se entró ilegalmente es la residencia privada de alguien. La penalidad puede incluir a lo máximo seis años de cárcel y una multa de hasta US$10.000.

Los cargos por asalto siempre son identificados como delitos mayores. La mayoría de los casos, son clasificados como delitos mayores de segundo grado con una penalidad máxima de 5 años de prisión y/o hasta US$10.000,00 en multas. Si el asalto se cometió contra un servidor público, o existen otras circunstancias atenuantes, se considerará un delito mayor de primer grado. Estos cargos llevan una penalidad máxima de 9 años de prisión y/o hasta US$10.000,00 en multas.
